GENERAL TERMS AND CONDITIONS OF SALE (GTCS)

These General Terms and Conditions of Sale (hereinafter referred to as the “GTCS”) govern all sales of goods and services carried out by the Municipal Tourist Office of Carcassonne, an EPIC registered under SIRET number 40347989200024, whose registered office is located at 28 rue de Verdun, Carcassonne (11890 CEDEX).

They apply without distinction to:
– sales made in the physical shop,
– sales made on the official website,
– ticket sales (guided tours, workshops, events, escape games, VR experiences, etc.),
– sales of Carca’Pass,
– sales of food and non-food products,
– services relating to the official escape game of the Municipal Tourist Office, developed in partnership with Hans Im Gluck,
– distance sales by telephone or any other channel implemented by the Office.

Any order implies full and unconditional acceptance of these GTCS, which prevail over any other document, except for mandatory statutory provisions.

ARTICLE 1 – PURPOSE

These GTCS aim to define the terms and conditions of sale, booking, delivery, collection, payment, cancellation, refund and, more generally, the reciprocal rights and obligations of the Municipal Tourist Office of Carcassonne and its customers, whether private individuals or professionals.

ARTICLE 2 – SCOPE OF APPLICATION

The GTCS apply to:

All products sold in the shop:
– Merchandise, publications, souvenirs, textiles, games, local products,
– Food products, in compliance with health and safety regulations.

All services:
– Guided tours, themed tours, workshops, conferences, VR experiences,
– Official escape game,
– Event and activity ticketing,
– Carca’Pass and other tourist passes,
– Mediation services and possible private bookings.

All orders placed:
– On site,
– Remotely (telephone, email),
– Via the official website of the Office.

No exemption from these conditions may be made without prior written agreement from the Management of the Tourist Office.

ARTICLE 3 – PRE-CONTRACTUAL INFORMATION

In accordance with Article L.221-5 of the French Consumer Code, the customer acknowledges having been informed prior to any purchase of:

– the essential characteristics of the product or service,
– the price including all taxes,
– payment terms,
– service performance conditions,
– any applicable restrictions (age, physical conditions, punctuality requirements, etc.),
– applicable cancellation conditions,
– exclusions from the right of withdrawal.

The Office reserves the right to update its information and prices at any time.

ARTICLE 4 – PRICES

Prices are expressed in euros (€) and include all taxes (VAT included).
The applicable prices are those in force at the time the order is placed.

The Municipal Tourist Office reserves the right to modify its prices at any time, while guaranteeing the application of the price indicated to the customer at the time of order validation.

ARTICLE 5 – ORDERS

An order is deemed firm and final:
– after full payment,
– after validation by the Office,
– and after express acceptance of these GTCS.

Any order placed online or in the shop implies irrevocable acceptance of the GTCS.

ARTICLE 6 – METHODS OF PAYMENT

The customer may pay using the following methods:

In the physical shop:
– Bank card (Visa, Mastercard),
– Cash,
– ANCV holiday vouchers (paper format),
– ANCV Connect,
– Cheque (if accepted by the establishment),
– Vouchers, gift cards or tourist passes accepted by the Office.

On the website:
– Bank card,
– ANCV Connect,
– Any other payment method added later and announced on the official website.

In the event of non-payment, partial payment or banking incident, the order is automatically cancelled.

ARTICLE 7 – TICKETING & DATED SERVICES

(guided tours, escape game, VR experiences, workshops, Carca’Pass, etc.)

7.1 – General principle: strict no-refund or modification policy

In accordance with Article L.221-28 of the French Consumer Code, no modification, exchange or refund is possible for dated services, regardless of the reason (delay, inability to attend, illness, absence, booking error, forgetfulness, weather conditions, etc.).

This rule applies in full to:
– guided tours,
– VR experiences,
– events,
– Carca’Pass,
– workshops and activities,
– the official escape game,
– any service associated with a specific date or time slot.

The customer acknowledges that reserving a time slot prevents the Office from reselling it to a third party.

7.2 – Delay / no-show / inability to access

Any delay by the customer, even of one minute, may result in the inability to participate in the service, with no refund.

Failure to attend at the scheduled time constitutes a waiver of the service without refund.


ARTICLE 8 – OFFICIAL ESCAPE GAME

The escape game is operated and managed by the Municipal Tourist Office of Carcassonne, in partnership with Hans Im Gluck, its financial and technical partner.

8.1 – Participation requirements

The customer undertakes to comply with:
– safety instructions,
– rules governing the use of equipment,
– instructions given by the supervising staff.

Any deliberate damage or behavior endangering staff or facilities may result in immediate exclusion without refund, as well as invoicing for any damage caused.

8.2 – Age, physical conditions, limitations

Specific conditions may apply (minimum age, physical ability, restrictions). These conditions are available on the presentation pages and must be strictly complied with.

8.3 – Delay and cancellation

No refund will be granted in the event of delay or absence.
Time slots may neither be postponed nor modified once validated.


ARTICLE 9 – FOOD PRODUCTS

In accordance with the provisions of the French Consumer Code relating to perishable goods, no return, exchange or refund of food products is possible once the goods have been collected or delivered, except in the event of a proven hidden defect or non-compliance.


ARTICLE 10 – RIGHT OF WITHDRAWAL

(online purchases excluding dated services and food products)

The 14-day right of withdrawal provided for by the French Consumer Code applies only to:
– non-food products,
– non-personalized products,
– non-dated products,
– purchased remotely (website, telephone).

The right of withdrawal does not apply to:
– all dated services (Article L.221-28),
– food products,
– unsealed items that cannot be returned for hygiene reasons,
– unsealed audio/video recordings or software.

ARTICLE 11 – REFUND PROCEDURE (authorized cases only)

In the rare cases where a refund is legally permitted (cancellation by the Office, hidden defect, admissible withdrawal), the customer must:

No refund can be processed without a fully completed form.

 
ARTICLE 12 – CANCELLATION BY THE OFFICE

The Office may exceptionally cancel a service (force majeure, safety requirements, external events, etc.).

In this sole case, either:
– a rescheduling, or
– a full refund

will be offered in accordance with the law.

No compensation other than reimbursement of the price paid may be claimed.


ARTICLE 13 – PERSONAL DATA PROTECTION (GDPR)

13.1 – Data controller

Municipal Tourist Office of Carcassonne – EPIC.

13.2 – Purposes

  • Commercial management of sales,

  • Ticketing and activity management,

  • Escape game booking,

  • Security and access management,

  • Internal statistics,

  • Commercial prospecting (subject to consent).

13.3 – Data subject rights

Any individual has the rights provided for in Articles 12 to 22 of the GDPR:
– right of access,
– right to rectification,
– right to erasure,
– right to object,
– right to restriction,
– right to data portability.

No other email address is authorized to process such requests.


ARTICLE 14 – LIABILITY

The Office shall only be liable for direct and foreseeable damage.

It cannot be held liable for:
– loss, theft or damage to personal belongings,
– abnormal or non-compliant use of facilities,
– booking errors attributable to the customer,
– consequences arising from failure to comply with safety rules.


ARTICLE 15 – INTELLECTUAL PROPERTY

All website content, visuals, texts, trademarks, graphic identities, escape game elements and educational resources are protected by intellectual property law.

Any reproduction without prior authorization is strictly prohibited.


ARTICLE 16 – DISPUTE RESOLUTION

In the event of a dispute, the customer may contact:

If the dispute persists, the customer may refer the matter to the consumer mediator designated in accordance with Article L.612-1 of the French Consumer Code.


ARTICLE 17 – ACCEPTANCE OF THE GTCS

Validation of an order constitutes full, unconditional and irrevocable acceptance of these General Terms and Conditions of Sale.
